Terms of Service

These Terms of Service (“Terms”) govern your use of the Gaite platform, including the website at gaite.ai, the Gaite application, and all related services (collectively, the “Service”), operated by Gaite, Inc. (“Gaite,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use Gaite. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. Gaite is not liable for any loss or damage arising from your failure to protect your account information.

If you are using Gaite through an employer-sponsored account, your employer may have provisioned your access. Your individual data remains private to you and is not accessible by your employer, as described in our Privacy Policy.

3. Subscriptions and Payment

Gaite offers paid subscription plans (Personal and Family) as well as employer-sponsored enterprise access. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page.

  • Subscriptions are billed on a recurring basis (monthly or annually) depending on your selected plan.
  • Payment is processed by Stripe. By subscribing, you also agree to Stripe’s terms of service.
  • You may cancel your subscription at any time. Your access continues until the end of the current billing period.
  • We reserve the right to change pricing with 30 days’ notice. Existing subscriptions will be honored at the current rate until their next renewal.
  • Refunds are handled on a case-by-case basis. Contact support@gaite.ai for refund requests.

4. Family Accounts

Family plan subscribers may invite up to 5 family members to create their own accounts under the family plan. Each family member has their own private account with their own data. The primary account holder is responsible for managing family membership and paying for the plan.

5. Acceptable Use

You agree to use Gaite only for lawful purposes. You may not:

  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Use the Service to transmit malware, viruses, or malicious code
  • Scrape, crawl, or extract data from the Service through automated means without permission
  • Misrepresent your identity or affiliation
  • Use the AI assistant to generate content that is illegal, harmful, or violates the rights of others

6. AI-Generated Content

Gaite uses artificial intelligence, including large language models, to provide guidance and generate content. You acknowledge and agree that:

  • Gaite is not a substitute for professional advice. The AI provides informational guidance, not legal, medical, financial, or therapeutic advice. Always consult qualified professionals for important decisions.
  • AI-generated content may occasionally be inaccurate, incomplete, or outdated. We work to minimize this, but we cannot guarantee the accuracy of all AI output.
  • You are responsible for evaluating and acting on AI-generated content at your own discretion.

7. Intellectual Property

The Gaite platform, including its design, code, content, logos, and trademarks, is the property of Gaite, Inc. and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes in accordance with these Terms.

Content you create within Gaite (your journeys, notes, documents, and conversations) belongs to you. We do not claim ownership of your content.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using Gaite, you consent to the practices described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Gaite is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • Gaite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.
  • Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Gaite, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may close your account at any time by contacting support@gaite.ai. We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. You may request export of your data before or within 30 days after account closure.

12. Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Wake County, North Carolina.

13. Modifications

We may revise these Terms from time to time. When we make material changes, we will notify you by email or through a notice in the application. The most current version will always be available at gaite.ai/terms. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
